PAC Match Frequently Asked Questions

When does the bp employee PAC Charity Match program begin and end?
The program runs on a twelve-month basis, beginning in January and ending in December, or until bp determines that changes are needed.

For the year 2023, the program opens for identifying charity match organizations to all Employee PAC eligible employees on November 1 and runs through the end of the year. If you are a current PAC member who is already contributing at the ½% support level or more, or if you choose to increase to this participation level by year end, your total 2023 contribution will be matched when distributions are made in February 2023. Who is eligible to request funding under the bp employee PAC Charity Match program? All PAC eligible bp employees who contribute a minimum of ½% salary or more to the bp employee PAC up to the Federal Election Commission's (FEC) legal annual limit of $5,000 are eligible for the match.

Employee PAC eligibility is defined by the FEC and generally includes U. S. citizen and green card holding employees, grade H and above.

PAC member qualifying contributions to the PAC will be matched by bp America with contributions to a maximum of three charities of the employee's choosing for contributions up to $5,000 annually. PAC members who make contributions to the PAC in an amount equal to the FEC maximum annual limit of $5,000 will be able to direct contributions equal to $1.50 for each $1 contributed to the PAC for a maximum annual match of $7,500. Members can direct that the matching contributions be made to one or divided among multiple (up to a maximum of three) 501(c) (3) charitable organizations meeting the bp Foundation eligibility requirements. Alternatively, members may direct up to $600 annually of their qualifying matching contributions to an organization meeting the eligibility criteria used by the bp Fabric of America with the balance, if any, directed to organizations meeting the bp Foundation eligibility requirements. The matching contribution(s) will indicate the matching gift is being made on your behalf—allowing you to support your favorite charity (ies) and the bp Employee PAC at the same time.
What happens to my qualifying matching funds if I do not designate charity options?
If an employee does not designate a charity prior to the stated deadline, the employee's charitable match will be forfeited. 
If my request is denied do I lose the ability to direct that matching contribution for the year?
No, if you request is denied you will be given the opportunity to submit a new request. To avoid delays, please ensure the request meets the eligibility requirements of the PAC Charity Match program prior to submission. 
What organizations are eligible for matching contributions?
501(c)(3) charitable organizations meeting the same eligibility requirements as the bp Foundation may receive matching contributions. PAC members may choose to split PAC matching contributions among up to three 501(c)(3) charitable organizations. Qualifying charitable organizations must be US-based with a US cause. One of the three options may be a smaller charity without a formal 501(c)(3) IRS designation, but it must have a U. S. charitable purpose, and EIN (Employee Identification Number) and operate on a not for profit basis. In this instance, matching contributions are limited to $600 annually for these smaller community charities. All remaining matching contributions must be directed to a 501(c)(3) charitable organization or split between two. Nominated organization names will be compared to US Government lists of prohibited and restricted parties and checked for compliance with the USA PATRIOT Act.

The following list is not exhaustive, but provides examples of eligible organizations:
  • Education – Public or non-profit schools, universities, pre-schools and other non-profit educational establishments.
  • Community – Community improvement or service organizations such as housing, job training, urban redevelopment, youth and community organizations.
  • Enterprise Development – Economic development and other organizations promoting and supporting the development of small and medium sized businesses and economic diversification.
  • Health & Human Service – Social welfare organizations dealing with health and medical issues, eradication of disease, drug rehabilitation, hunger, HIV/AIDS, as well as adult and youth programs dealing with unemployment, homelessness and social welfare. Organizations/causes that provide medical services, medical supplies or educational materials to the greater community and allow those served the right to make their own health decisions.
  • Environment – Organizations concerned with environment, nature and wildlife preservation including animal welfare, water usage, pollution prevention, recycling and energy conservation.
  • Culture & Arts – Museums, theaters, orchestras, historical societies, performing arts companies, libraries, public television and public radio stations.
    Community human services affiliated with faith based organizations – charitable funds directed and used exclusively for a program that is wholly for the benefit of the general public (food pantry/soup kitchen, homeless shelter, etc.). 
What organizations are not eligible for matching contributions?
The following is a list that includes, but is not limited to, organizations that are not eligible for matching funds:

  • Organizations and/or causes outside of the US that fund individual or group international travel.
  • Organizations that fund materials for use outside of the US.
  • Organizations that are US-based but perform their non-profit activities outside of the US.
  • Political or fraternal organizations.
  • Religious organizations and programs, except to the extent that contributions will be used exclusively for a program that is wholly for the benefit of the general public (food pantry/soup kitchen, homeless shelter, etc.) and is non-denominational and non-sectarian in nature.
  • Organizations that discriminate or limit membership based on race, gender, beliefs, class or cultural considerations.
  • Payments in lieu of tuition or payments of class fees, alumni association fees, membership payments or fees for any service or similar payments.
  • Payments earmarked for a specific recipient and do not benefit the “greater good.”

    Requests are reviewed on a case-by-case basis and past approval does not constitute current approval of the organization. If and when more detail is known about the intent of the organization, bp can reassess its current and future support.

    bp America maintains a neutral position. Any views or opinions presented in the selection of organizations are solely those of the employee and do not represent those of bp.
    Employees of bp are expressly required to abide by bp's Code of Conduct at all times, including when utilizing the bp employee PAC Charity Match program. Due to the flexibility of the bp employee PAC Charity Match program's guidelines, bp America reserves the right to refuse requests for contributions to organizations whose objectives are deemed to be harmful or adverse to the interests of bp.
         
Can contributions be used to purchase dinner or event tickets, raffle tickets or auction items?
No. To avoid making matching contributions that could be considered taxable income, bp employee PAC Charity Match program contributions cannot be used to purchase dinner or event tickets, raffle tickets or auction items, to pay membership dues, or to provide any other personal benefit to employees or their family members. Employees wishing to attend a fundraising event or to purchase raffle tickets or auction items will need to purchase such tickets or items on their own.
What are examples qualifying activities that will be eligible for the $600 annual maximum amount?
Here are some examples of activities that are eligible for the contribution:

  • Helping a local high school debate team offset the costs of going to a state competition (this could be any type of school team or activity).
  • Funding for the Humane Society's annual fundraiser - fundraiser must be for the “greater good”.
  • Donating to the Future Farmers of America's annual fundraiser. The organization accepting the money may use the contribution in its sole discretion, including using the contribution to acquire an item to be auctioned, but bp will not donate an auction item under this program. bp's contribution cannot be used to bid on auction items. Employees wishing to participate in auctions must use their own money to do so.
  • Funding to support a food pantry or homeless shelter, including those affiliated with a faith-based organization as long as the funds are not used specifically for the religious purposes of the organization.
  • Charity organizations without a formal 501 (c) (3) IRS designation, which conduct these type of qualifying activities, may be eligible to receive the $600 maximum annual match provided they have a U. S. charitable purpose, and EIN (Employee Identification Number) and operate on a not for profit basis, similar to the Fabric of America requirement.
Are there minimum and maximum contributions from the bp employee PAC Charity Match program?
Yes, bp America checks will be written for bp employee PAC contributions for those Employee PAC eligible employees who make contributions the PAC of at least ½% annual salary, up to $5,000 annually, the FEC legal limit. PAC members who make contributions to the PAC in an amount equal to the FEC maximum annual limit of $5,000 will be able to direct contributions equal to $1.50 for each $1 contributed to the PAC for a maximum annual match of $7,500. Matching contributions to organizations that are similar to Fabric of America requirements are limited to receiving $600 annually. The remaining balance of an employee's PAC annual matching contribution may be split between any two 501(c) (3) organizations - or directed to a single organization - meeting bp Foundation eligibility requirements.
Will the charity (ies) know that the matching gift(s) was made on my behalf?
Yes, even though the matching gift(s) will be paid by bp America, your name will be listed on the cover letter to the charity (ies) along with the contribution. If you wish to remain anonymous, please indicate that during your enrollment.
How will the program be monitored and/or audited?
bp employee PAC Charity Match program requests will be reviewed by bp America staff and will be audited for compliance. bp America regards inappropriate use of the program as serious misconduct. Anyone making inappropriate use of the program will be disciplined, up to and including dismissal.
Are there any considerations related to the bp Code of Conduct?
Compliance with anti-bribery and anti-corruption laws is a key component of the bp Code of Conduct (the "Code"). Even the appearance of a violation of these laws could be harmful. bp employees must avoid directing bp Employee Charity Match program funds to organizations under circumstances in which it could reasonably be inferred that the contribution is intended to influence a public official's performance of official duties. In particular, contributions should not be made to a school or non-profit organization in response to a financial solicitation by a public official (at the federal, state, or local level) or to an organization affiliated with a public official or a relative of a public official without the prior approval of bp. Employees will be asked about solicitation by a public official as part of the contribution request process.

We expect all our employees and contractors to act in a way that is consistent with our Code and follow its principles.

Employees are required to disclose any affiliation they have with the potential recipient to ensure there is no conflict of interest. An affiliation with the organization is not against the guidelines, nor does it automatically disqualify the organization from receiving a matching contribution; however, it is necessary for full transparency and will be used to determine if the recipient and cause are within the guidelines of the bp employee PAC Charity Match program.

Do I need to get a copy of an organization’s IRS determination letter?
No, bp will review and approve your charity selections against requirements established under the PAC Charity Match program.
What information do I need to get started?
To submit a matching contribution request through the bp employee PAC website on the enrollment form, you will need the following information:

  • Organization name
  • Organization mailing address
  • Organization EIN (Employee Identification Number)
  • Organization contact name
  • Organization contact phone number
  • Organization contact email address

What happens to my qualifying matching funds if I do not designate charity options?
An employee’s qualifying PAC matching funds will automatically go to the United Way in the employee’s work area - or other bp charity partners selected annually by bp Community Relations - when the employee does not designate a charity (ies). Employees who do not designate - and whose matching funds are automatically directed to their local United Way - will receive recognition under the bp annual United Way campaign, just as if they had made the contribution directly to the United Way. Employees who do choose to direct PAC matching funds to the local United Way, will also receive recognition under the bp annual United Way campaign.
What if I do not understand the guidelines of the bp employee PAC Charity Match program?
Employees will be required to acknowledge their understanding of bp employee PAC Match program guidelines prior to submitting a request.
